CMA Warns from Crossing Wadis and Urges to Observe Highest Standards of Safety to Preserve Life and Property

 

CMA Emphasizes that any Claim Resulting from Adverse Practices during rainy weather will be rejected

 

The Capital Market Authority calls on citizens and residents to follow up and adhere to the warnings issued by the concerned authorities and to observe highest standards of caution and attention during the rainy weather and Wadis flooding during Al Rayan Trough.

 

CMA would like to state that it noticed in the past rainy seasons a number of adverse practices by individuals such as venturing in crossing Wadis intentionally or leaving vehicles exposed to the flooding. Hence, it continuously urges insurance companies to consider and analyze the damage caused by weather conditions. CMA carefully considers the complaints filed by those who incur damage to ensure they are entitled to compensation stressing that it rejected a number of claims after being established that the damage was caused intentionally by the owner of the vehicle.

 

CMA stresses that the Unified Motor Vehicle Insurance Policy requires the owner to take all required precautions to preserve the vehicle and not to venture crossing the Wadis as well as adhering to the instructions of the concerned entities as intentional crossing of wadis and failure to comply with the warnings of the concerned authorities forfeits the rights in compensation if it is evident the damage caused by intentional act.

 

The warnings issued by the Civil Aviation Authority indicate that some Wilayats will witness heavy rain and Wadis flow and urged the citizens and residents to exercise caution and check visibility to preserve life and property.

 

The Unified Motor Vehicle Insurance Policy states in Clause 2 of Chapter 6

 “The Insured shall take all reasonable steps to safeguard the insured vehicle from loss or damage and maintain the vehicle in roadworthy condition. The Insurer shall have at all times free and full access to examine the vehicle or any part thereof.”

 

Clause 11 provides “The Insurer may refrain from payment of compensation to the Insured for damage to the insured vehicle under a comprehensive cover or for bodily injuries sustained by the Insured and any one in his position and their family members and medical and first aid expenses if the Policy covers such injuries, in the following cases:

Clause (d) “If it is proved that the accident, death or bodily injury resulted from a willful act of the Insured. “
